PROTECTION OF THE RIGHTS AND BENEFITS OF THE BABY IN MARRIAGE CASES

Abstract

Recently, as the society grows, divorce is a phenomenon attracting more and more social attention due to its heavy consequences. In principle, when the couple’s life falls into serious conditions, the common life can not last long, so the purpose of marriage is not reached. The divorce is a choice to free the impasse in daily life. However, neither solution is perfect. Divorce is the end of an unsuccessful marriage but it is the beginning of a social problem to be dealt with. Children have to suffer heavy consequences of the divorce. In both the official law and the Law on Marriage and the Family, the protection of children’s rights is a system of measures, mechanisms and methods that are provided for by law. The purpose is ensuring the actual rights and legitimate benefits of children, the children’s basic rights are not violated, limited or negatively influenced by parental divorce. Another objective is to certify strict and in time punishments on all trespassing activities upon children’s legitimate rights and benefits.
